Does the minister accept that, in the event that the Court of Appeal overturns or otherwise waters down the Summerfield decision, in that case the increase of the threshold of the whole person impairment to 35 per cent to seriously injured workers will catastrophically affect injured workers?

The legislation is based on estimates that have been made in relation to how many will reach 35 per cent and how many injured workers will be able to combine where they couldn't combine for seriously injured before. It's our intention that those numbers are maintained in the system.
