          <inserted>Section 66N(3) of the Summary Offences Act 1953 provides that a declaration of a declared public precinct may be made either on the Attorney-General's own motion, or on the recommendation of the commissioner.</inserted>

          <inserted>In practice, such declarations have been made on recommendation by the Commissioner of Police. This is particularly because such a declaration can only be made by the Attorney-General if they are satisfied of the matters set out in section 66N(2). Advice and material from South Australia Police has been important in the Attorney-General being satisfied that these criteria have been met prior to making declarations.</inserted>
