          <inserted>1.&amp;#x9;I have been advised by the Office for Recreation, Sport and Racing that since December 2019 they have responded to two items of correspondence regarding concerns around gender policies in sports.</inserted>

          <inserted>2.&amp;#x9;I have been informed by the Office for Recreation, Sport and Racing that numerous national sporting bodies have implemented policies and resources for the inclusion of transgender and gender diverse people in elite and community sport in accordance with their gender identity.</inserted>

          <inserted>These include Cricket Australia, AFL, Hockey Australia, NRL Touch Football Australia, Athletics Australia, Tennis Australia, Rugby Australia, Rowing Australia, Water Polo Australia and Sport Climbing Australia.</inserted>

          <inserted>The Office for Recreation, Sport and Racing is aware of at least two state sporting organisations that have policies in place which support the inclusion of transgender athletes in their sports and have transgender athletes actively participating in their community competitions.</inserted>

          <inserted>3.&amp;#x9;The participation of transgender and gender diverse people in sport comes under section 48(a) of the Sex Discrimination Act (Cth) 1984 and gives the Australian Human Rights Commission the power to publish guidelines 'for the avoidance of discrimination' on the grounds of sex and gender identity.</inserted>

          <inserted>The governance of sport is the responsibility of national and state sporting organisations and the determination of the eligibility of their athletes in competitions are primarily contained in their rules and/or by-laws, noting the requirements of section 48(a).</inserted>

          <inserted>The Office for Recreation, Sport and Racing support the guidelines for the inclusion of transgender and gender diverse people in sport developed by the Australian Human Rights Commission, Sport Australia and the Coalition of Major Professional and Participation Sports launched in June 2019.</inserted>
