In these sorts of matters it is always open to someone who is making an application for a review or taking an appeal to raise issues that they think are important as they see fit. It is entirely open to the legal team representing someone to raise an issue that they think a court should take into account when assessing what action to take. If the applicant in this particular case (or any case, for that matter) feels that there has been a miscarriage of justice in any way, shape or form, it is entirely open for that applicant's legal team to put such information before the court for the court to assess it.
