            <inserted>(1)&amp;#x9;A court before which a defendant is to be tried on information may, on application by the prosecutor, require the defence to give the prosecution written notice of an intention to introduce evidence of any of the following kinds:</inserted>

            <inserted>(a)&amp;#x9;evidence tending to establish that the defendant was mentally incompetent to commit the alleged offence or is mentally unfit to stand trial;</inserted>

            <inserted>(b)&amp;#x9;evidence tending to establish that the defendant acted for a defensive purpose;</inserted>

            <inserted>(c)&amp;#x9;evidence of provocation;</inserted>
          </item>

            <inserted>(e)&amp;#x9;evidence tending to establish that the circumstances of the alleged offence occurred by accident;</inserted>

            <inserted>(f)&amp;#x9;evidence of necessity or duress;</inserted>
          </item>
        </text>

            <inserted>(g)&amp;#x9;evidence tending to establish a claim of right;</inserted>
          </item>
        </text>

            <inserted>(h)&amp;#x9;evidence of intoxication.</inserted>

          <item sublevel="2">
            <inserted>(2)&amp;#x9;Before making an order under this section, the court must satisfy itself that—</inserted>
          </item>
        </text>
        <text id="2017051875155488b3484c6f80001096">
          <item sublevel="3">
            <inserted>(a)&amp;#x9;the prosecution has provided the defence with the prosecution case statement in accordance with section 123; and</inserted>
          </item>
        </text>
        <text id="2017051875155488b3484c6f80001097">
          <item sublevel="3">
            <inserted>(b)&amp;#x9;the prosecution has no existing, but unfulfilled, obligations of disclosure to the defence.</inserted>
          </item>
        </text>

          <item sublevel="2">
            <inserted>(3)&amp;#x9;Non-compliance with a requirement under subsection (1) does not render evidence inadmissible but the prosecutor or the judge (or both) may comment on the non-compliance to the jury.</inserted>

            <inserted>(4)&amp;#x9;A court before which a defendant is to be tried on information may require the defence to notify the prosecutor, in writing, whether the defendant consents to dispensing with the calling of prosecution witnesses proposed to be called to establish the admissibility of specified intended evidence of any of the following kinds:</inserted>
          </item>

          <item sublevel="3">
            <inserted>(a)&amp;#x9;documentary, audio, visual, or audiovisual evidence of surveillance or interview;</inserted>
          </item>
        </text>

            <inserted>(b)&amp;#x9;other documentary, audio, visual or audiovisual evidence;</inserted>
          </item>
        </text>

            <inserted>(c)&amp;#x9;exhibits.</inserted>
          </item>
        </text>

          <item sublevel="2">
            <inserted>(5)&amp;#x9;If the defence fails to comply with a notice under subsection (4), the defendant's consent to the tender of the relevant evidence for purposes specified in the notice will be conclusively presumed.</inserted>

            <inserted>(i)&amp;#x9;a firearm or imitation firearm (ie an article intended to be taken for a firearm); or</inserted>
          </item>

          <item sublevel="3">
            <inserted>(ii)&amp;#x9;an explosive or an imitation explosive (ie an article or substance intended to be taken for an explosive); or</inserted>
          </item>
        </text>

          <item sublevel="2">
            <inserted>(b)&amp;#x9;an article or substance that a person has—</inserted>
          </item>
        </text>
        <text id="2017051875155488b3484c6f80001111">
          <item sublevel="3">
            <inserted>(i)&amp;#x9;for the purpose of causing personal injury or incapacity; or</inserted>
          </item>
        </text>
        <text id="2017051875155488b3484c6f80001112">
          <item sublevel="3">
            <inserted>(ii)&amp;#x9;in circumstances in which another is likely to feel reasonable apprehension that the person has it for the purpose of causing personal injury or incapacity.</inserted>
