        <text id="20071023ddfc1026a3304a5fb0001040">The Legislative Council agreed to the bill with the amendment indicated by the following schedule, to which amendment the Legislative Council desires the concurrence of the House of Assembly:</text>
        <text continued="true" id="20071023ddfc1026a3304a5fb0001041">No.1. Clause 5, page 3, lines 5 to 14—</text>
        <text id="20071023ddfc1026a3304a5fb0001042">Delete proposed subsections (1) and (2) and substitute:</text>
        <text id="20071023ddfc1026a3304a5fb0001043">(1)&amp;#x9;A person is guilty of an offence if—</text>
        <text id="20071023ddfc1026a3304a5fb0001044">
          <item sublevel="2">(a)&amp;#x9;the person, without lawful excuse, acts in a manner that creates a substantial risk of death or serious harm to another who is in a workplace; and</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001045">
          <item sublevel="2">(b)&amp;#x9;the person—</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001046">
          <item sublevel="3">(i)&amp;#x9;knew that his or her act or acts would create that risk; or</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001047">
          <item sublevel="3">(ii)&amp;#x9;was recklessly indifferent about whether his or her act or acts would create that risk.</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001048">
          <item sublevel="2">Maximum penalty:</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001049">
          <item sublevel="2">(a)&amp;#x9;in the case of a natural person—imprisonment for 5 years or double the Division 1 fine;</item>
        </text>
        <text id="20071023ddfc1026a3304a5fb0001050">
          <item sublevel="2">(b)&amp;#x9;in the case of a body corporate or an administrative unit in the Public Service of the State—double the Division 1 fine.</item>
