FOLEY (Port Adelaide—Deputy Premier, Treasurer, Minister for Industry and Trade, Minister for Federal/State Relations): I am advised that should the Common User Facility not be available as required by the Commonwealth, in accordance with the Design Development Deed, the Minister for Economic Development is required to indemnify the Commonwealth for actual losses incurred due to the delay. At this point in time, the state cannot estimate what losses may be incurred by the Commonwealth due to project delays. As previously stated, Defence SA is confident that the facility will be available as required and the Commonwealth will not experience any delays.
